Current public forms and the facts that decide whether each one belongs in a Texas owner sale.

There is no universal TREC packet legally required in every Texas FSBO sale. Section 5.008, federal lead rules, and several location or transaction notices apply only when their own conditions are met.

Generally required when Section 5.008 applies

Texas Property Code Section 5.008 covers a seller of residential real property containing no more than one dwelling unit, subject to the statute's exceptions. The seller must give a written notice in the statutory form or one that is substantially similar. TREC describes Form 55-1 as a voluntary form for satisfying the statute.

Fact-triggered Texas and federal notices

TREC's own 2026 legal update says it is false that every legally required seller disclosure appears in the Seller's Disclosure Notice. See TREC Legal Update I, the special district form page, and EPA's federal lead guidance.

Optional contract template

Texas Business and Commerce Code Section 26.01 generally requires a contract for the sale of real estate, or a memorandum of it, to be written and signed by the person against whom enforcement is sought. That rule does not make a TREC template universally mandatory for an owner selling without representation. TREC 20-19 is a public template for a qualifying residential resale, but its own scope and warnings matter.

What is not included

This page does not provide a deed, seller-financing instrument, PID notice, district-specific MUD notice, or a complete closing packet. A deed must fit the ownership, title, legal description, warranty, marital, lien, and recording facts. Use a Texas real estate attorney and title company.

Questions people ask

Is the TREC Seller's Disclosure Notice required in every Texas FSBO sale?

No. Texas Property Code Section 5.008 applies to specified residential property and contains exemptions. TREC 55-1 is a voluntary form designed to satisfy that section when it applies.

Does a Texas FSBO seller have to use TREC contract 20-19?

No government contract template is universally mandatory for an unrepresented owner. A signed writing is generally needed for enforceability, and TREC 20-19 is a public template for a qualifying one-to-four family resale. An attorney should confirm whether it fits the transaction.

Where can a seller get a MUD or special district notice?

The district should provide a current notice containing its own information. TREC says to use the district form when available. TREC 59-0 is a backup for certain special taxing or assessment districts and is not for PIDs.

What if the Texas home was built before 1978?

Most covered pre-1978 housing sales require federal lead information, records, warning language, the EPA pamphlet, and an inspection opportunity. Federal exceptions exist, so confirm coverage before relying on a form.
